Terms of Service - North Shore Nail Atelier

1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services, facilities, website, booking systems, communications, and related offerings provided by North Shore Nail Atelier ("we," "us," "our"). By booking an appointment, visiting our studio, purchasing a service, using our website, or otherwise engaging with our business, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or facilities. These Terms apply to all clients, visitors, and users of our services, whether in person, by phone, by email, or online.
Our business is operated as a nail-studio located at 2180 Yonge Street, Toronto, ON M4S 2C7, Canada.
2. Scope of Services
North Shore Nail Atelier provides professional nail and foot care services, which may include, without limitation:
- Classic manicure
- Gel manicure
- Pedicure and foot care
- Nail extensions and sculpting
- Custom nail art
- Paraffin treatment
- Nail repair and maintenance
Service descriptions, duration estimates, pricing, and availability may change at any time without prior notice, subject to applicable law. We reserve the right to refuse or discontinue services where we reasonably believe it is necessary for health, safety, legal, operational, or professional reasons.
Our services are cosmetic and personal care services only. They are not medical, podiatric, dermatological, or therapeutic treatments, and should not be relied upon as such.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information when booking or receiving services.
- Disclose any allergies, sensitivities, skin conditions, infections, injuries, medical conditions, pregnancy-related concerns, or other relevant health information before treatment.
- Follow all pre-appointment and aftercare instructions provided by us.
- Arrive on time for appointments and respect studio policies and staff instructions.
- Maintain respectful conduct toward our staff, other clients, and the studio environment.
- Not attend appointments if you are ill, contagious, or otherwise advised not to receive cosmetic services.
- Not interfere with the safe and professional delivery of services.
You acknowledge that failure to disclose relevant health or safety information may increase the risk of adverse reactions, service limitations, or injury, and may affect our ability to provide services safely.
Minors may only receive services with the consent of a parent or legal guardian and subject to any age-related restrictions we may impose in our discretion and in accordance with applicable law.
4. Payment Terms and Conditions
Payment is due at the time services are rendered unless otherwise agreed in writing by North Shore Nail Atelier. We may require deposits, prepayments, or card authorization for certain services, appointments, group bookings, or peak periods.
- All prices are listed in Canadian dollars unless stated otherwise.
- Applicable taxes, including GST/HST, will be charged where required by law.
- We accept payment methods as displayed in-studio or communicated at the time of booking.
- Tips or gratuities, if offered, are voluntary and not included in service prices.
If a payment is declined, reversed, disputed, or otherwise not successfully completed, you remain responsible for the full amount due, including any applicable fees permitted by law. We reserve the right to suspend future bookings or services until outstanding balances are paid.
5. Cancellation and Refund Policy
We value your time and ours. If you need to cancel or reschedule, please provide notice as early as possible. Specific cancellation windows, deposit forfeiture rules, and no-show fees may be communicated at booking or posted in-studio.
- Late cancellations may result in a cancellation fee or forfeiture of any deposit, to the extent permitted by law.
- No-shows may be charged the full or partial service fee, subject to applicable law and prior notice of the policy.
- Repeated late cancellations or no-shows may result in refusal of future bookings.
Due to the personal and consumable nature of nail and foot care services, all completed services are generally non-refundable. If you have a concern about a service, you must notify us promptly, and in any event within a reasonable time after the service is completed, so that we may assess the issue.
Where required by applicable consumer protection law, any statutory rights you may have remain unaffected. Nothing in these Terms limits rights that cannot legally be excluded or restricted under applicable law in Ontario or Canada.
6. Liability Limitations
To the fullest extent permitted by applicable law, North Shore Nail Atelier, including its owners, employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of our services, studio, or website.
You acknowledge that cosmetic nail and foot care services involve inherent risks, including but not limited to allergic reactions, irritation, lifting, breakage, infection, discomfort, or dissatisfaction with aesthetic results. While we use reasonable care and professional standards, we do not guarantee specific outcomes.
Our liability for any claim arising from or related to our services shall be limited to the amount paid by you for the specific service giving rise to the claim, to the extent permitted by law. This limitation does not apply where prohibited by law, including liability that cannot be limited for reasons of negligence, gross negligence, wilful misconduct, or other non-excludable obligations under applicable law.
You are responsible for following aftercare instructions and for seeking appropriate medical attention if you experience signs of infection, allergic reaction, or other adverse effects.
7. Intellectual Property Rights
All content created, displayed, published, or made available by North Shore Nail Atelier, including but not limited to logos, branding, service descriptions, photographs, designs, text, graphics, artwork, and website materials, is owned by us or our licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, publicly display, sell, or otherwise use our intellectual property without our prior written consent, except as permitted by law.
Any custom nail art, designs, or creative work produced during a service may be photographed or displayed by us for portfolio, marketing, or promotional purposes, unless you expressly object in writing before the service begins and unless otherwise restricted by law. Any client-provided images or materials remain the property of their respective owners.
8. Data Protection and Privacy
We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including, where applicable, the Personal Information Protection and Electronic Documents Act (PIPEDA) and any relevant provincial privacy requirements.
Personal information may include your name, contact details, appointment history, payment information, service preferences, health-related information relevant to safe service delivery, and communications with us. We use this information to:
- Schedule and manage appointments;
- Provide services safely and professionally;
- Process payments and maintain business records;
- Communicate with you about bookings, policies, and service-related matters;
- Comply with legal, tax, accounting, and regulatory obligations.
We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
By using our services, you consent to the collection, use, and disclosure of your personal information as described in these Terms and in any separate privacy notice we may provide. If you provide information about allergies, medical conditions, or other health-related matters, you consent to our use of that information for service safety and risk management purposes.
9. Force Majeure
North Shore Nail Atelier shall not be liable for any delay, interruption, cancellation, or failure to perform caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, severe weather, power outages, labour disputes, public health emergencies, government actions, supply shortages, transportation disruptions, or internet or telecommunications failures.
In such circumstances, we may reschedule appointments, modify services, or temporarily suspend operations without liability, subject to applicable law.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective when posted, communicated, or otherwise made available to you, unless a later effective date is stated.
Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services.
11. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any mandatory consumer protection rights or other non-waivable legal rights, you agree that any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, unenforceable, or contrary to applicable law by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
The failure of North Shore Nail Atelier to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless expressly acknowledged in writing.
